1. About these Terms

These Terms of Service and Sale apply to the use of grunchyshop.com and to purchases made through the online store.

The seller and operator of the store is:

Grunchyshop is a brand name and is not a separate legal entity.

By placing an order, you agree to these Terms, the Return and Refund Policy, the Shipping Policy and the Privacy Policy applicable at the time of the order.

Nothing in these Terms limits any mandatory consumer rights available under the law applicable to you.

2. Products

We sell Grunchyshop-branded lanyards, related accessories and electronic gift cards.

Our physical products are manufactured in Latvia and Portugal.

We make reasonable efforts to ensure that product descriptions, measurements, materials, images and other information are accurate.

Colours and appearance may vary slightly depending on lighting, photography, screen settings and manufacturing tolerances. Such minor differences do not affect your statutory rights where the product does not conform to the sales contract.

Product availability may change. Adding a product to the shopping cart does not reserve the product.

3. Prices

All consumer prices displayed in the store include applicable VAT unless clearly stated otherwise.

Delivery costs and any other mandatory charges are displayed at checkout before you place the order.

The price charged is the price displayed when the order is submitted, subject to the correction of an obvious pricing error that a reasonable customer should have recognised.

Prices, promotions and product availability may change before an order is placed. Changes do not affect orders that have already become binding.

4. Placing an order

Before submitting an order, you must check:

  • the selected products;

  • quantities;

  • delivery information;

  • contact information;

  • delivery method;

  • payment method; and

  • total price.

You are responsible for providing accurate and complete information.

By clicking the final payment or order button, you submit an order with an obligation to pay.

A binding sales contract is formed when we send an order confirmation accepting the order to the email address provided at checkout.

Please save the order confirmation and these Terms for your records.

5. Order acceptance and cancellation by us

We may refuse or cancel an order only for a legitimate reason, including:

  • the product is unavailable;

  • payment cannot be authorised;

  • the order information is materially incomplete or incorrect;

  • there is a reasonable suspicion of fraud or misuse;

  • delivery to the address is unavailable;

  • the order breaches purchase limits or these Terms; or

  • the price or product information contains an obvious material error.

If we cancel an order after payment has been collected, we will notify you and refund the amount paid without undue delay using the original payment method.

6. Payment

Payment is charged when the order is placed.

Payments are processed through Shopify Payments. The payment methods available to you are displayed at checkout and may vary by country, device and order.

The payment service provider may carry out payment verification, authentication and fraud-prevention checks.

We do not charge a separate fee solely for using an available consumer payment method unless such a fee is expressly permitted by law and displayed before the order is submitted.

7. Delivery

We deliver only to the countries listed in our Shipping Policy and supported at checkout.

Estimated delivery times, delivery charges, carriers, transfer of risk and procedures for delayed, lost or uncollected parcels are described in our Shipping Policy.

Unless otherwise agreed, products will be delivered without undue delay and no later than 30 days after the contract is concluded.

The risk of loss of or damage to products remains with us until you, or a third party designated by you other than the carrier, takes physical possession of them, unless you independently arranged a carrier not offered by us.

8. Right of withdrawal and returns

Consumers generally have a statutory right to withdraw from an online purchase within 14 days of receiving the goods without giving a reason.

We also provide a voluntary 30-day return policy for eligible physical products.

The conditions, instructions, free return procedure, refund terms, electronic withdrawal function and model withdrawal form are provided in our Return and Refund Policy.

Failing to collect a parcel does not constitute a valid withdrawal notification.

9. Defective and non-conforming products

We are responsible for products that do not conform to the sales contract in accordance with applicable mandatory consumer law.

A product may be non-conforming if, for example, it:

  • is not as described;

  • is not suitable for its normal purpose;

  • lacks agreed features;

  • is delivered damaged; or

  • does not meet mandatory quality, durability or safety requirements.

Depending on the circumstances and applicable law, the available remedies may include repair, replacement, a price reduction or termination of the contract and a refund.

Remedies for defective products will be provided without charge where required by law.

10. Electronic gift cards

Grunchyshop gift cards:

  • are issued electronically;

  • are delivered by email;

  • are valid only at grunchyshop.com;

  • are valid for 24 months from the date of purchase;

  • may be used until the balance is exhausted or the validity period ends;

  • cannot normally be exchanged for cash;

  • may be used together with another available payment method where the gift card balance is insufficient; and

  • are subject to the statutory withdrawal terms stated in our Return and Refund Policy.

The gift card code functions as a means of payment. You are responsible for keeping the code secure.

Contact us promptly if you believe a gift card code has been obtained or used without authorisation. We are not responsible for unauthorised use caused by the customer deliberately sharing the code or failing to take reasonable care of it, except where mandatory law provides otherwise.

Expiry of a gift card does not affect claims relating to a technical error, unauthorised use caused by us or another statutory right.

11. Discount codes and promotions

Discount codes and promotions are subject to any specific conditions displayed with the offer.

Unless otherwise stated:

  • discount codes must be entered before the order is submitted;

  • only one discount code may be used per order;

  • discount codes cannot be exchanged for cash;

  • discounts do not apply retrospectively;

  • codes may be limited by date, customer, product, country or order value; and

  • promotions are available while stocks last.

These conditions do not limit statutory rules applicable to price reductions and marketing.

12. Customer accounts

You may be able to create a customer account.

You must provide accurate information and keep your login credentials confidential. You are responsible for activity carried out through your account to the extent permitted by applicable law.

Contact us promptly if you believe your account has been accessed without authorisation.

We may restrict or close an account where this is reasonably necessary to protect the customer, other users, our services or our legal rights. Closing an account does not affect existing orders, statutory rights or legal retention obligations.

13. Product reviews

Product reviews may be collected and displayed through Judge.me.

Reviews must reflect a genuine experience and must not contain:

  • unlawful content;

  • threats or harassment;

  • personal data relating to another person;

  • misleading claims;

  • spam;

  • malicious code;

  • content that infringes intellectual property or other rights.

We may moderate or remove content where reasonably necessary for legal, security or service-integrity reasons.

Where a review has been incentivised, this must be disclosed clearly.

14. Intellectual property

The content of the store, including the Grunchyshop name, logos, designs, product photographs, graphics, text, videos and layout, is owned by Henriikka Creative Oy or used under licence.

You may access and use the store for personal and lawful purposes.

You may not reproduce, distribute, modify, republish, commercially exploit or systematically extract store content without prior written permission, except where permitted by law.

Nothing in these Terms transfers ownership of intellectual property rights to you.

15. Acceptable use

You must not use the store:

  • for unlawful or fraudulent purposes;

  • to infringe the rights of another person;

  • to introduce malware or harmful code;

  • to interfere with the security or operation of the store;

  • to attempt unauthorised access to accounts or systems;

  • to collect personal data unlawfully;

  • to impersonate another person; or

  • to submit false or misleading order information.

Reasonable automated access by search engines and services authorised by us is permitted. Other automated scraping or extraction that materially burdens the store or infringes rights is prohibited.

16. Third-party services and links

The store uses services provided by third parties, including Shopify, payment providers, delivery carriers and other service providers identified in our Privacy Policy.

Third-party services may be governed by their own terms and privacy policies.

Links to independent third-party websites are provided for convenience. We are not responsible for the content, availability or practices of independent third-party websites.

This section does not limit our responsibility for services or providers that we use to perform our obligations under the sales contract.

17. Availability of the store

We aim to keep the store available and secure but do not guarantee uninterrupted access.

Access may be temporarily restricted for maintenance, security, technical failures or circumstances outside our reasonable control.

Temporary website unavailability does not limit your rights relating to an existing order.

18. Liability

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including statutory responsibility for defective products, non-performance of the sales contract, personal injury caused by negligence or intentional misconduct.

Subject to mandatory law, we are not responsible for indirect losses that were not reasonably foreseeable when the contract was concluded.

We are not responsible for a delay caused by an exceptional and unavoidable circumstance outside our reasonable control. We will nevertheless take reasonable steps to minimise the effects and will respect any cancellation, refund or other rights provided by mandatory consumer law.

19. Privacy

Personal data is processed in accordance with our Privacy Policy.

Non-essential cookies and similar technologies are managed through Shopify Customer Privacy and your cookie preferences.

20. Changes to these Terms

We may update these Terms for future use of the store or future orders.

The Terms applicable to an order are the Terms in force when the order becomes binding.

Changes will not apply retroactively to an existing order unless required by law or expressly agreed with you.

The current version is published on this page with the date of the latest update.

21. Governing law and jurisdiction

These Terms and sales contracts concluded with us are governed by Finnish law.

This choice of law does not deprive a consumer of mandatory protection provided by the law of the consumer’s country of habitual residence.

A consumer may bring legal proceedings before any court having jurisdiction under applicable consumer and procedural law, including the courts of the consumer’s country of residence where applicable.

22. Consumer dispute resolution

Please contact us first at info@grunchyshop.com so that we can attempt to resolve the matter directly.

If a dispute concerning a sales contract cannot be resolved through negotiations, a consumer may contact the Finnish Consumer Advisory Services for guidance and mediation.

23. Severability

If a provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in effect.

The invalid provision will be interpreted or replaced to the minimum extent necessary to comply with applicable law.
